How are companies and human rights related?
In recent years, the consideration of the potential negative impact of business activities on human rights has been established – with more force and relevance.
This has gained importance worldwide – due to globalization and the explosion of targeted communication – and has invaded the agenda of major institutions of international and regional systems, through various instruments and regulations.
Currently, there is a combination of soft law instruments and mandatory legislation that governs the actions of States and the companies that operate in their jurisdictions.
This is how the United Nations Guiding Principles, the OECD Guidelines, the fundamental Conventions of the International Labor Organization (ILO), the OAS standards and the new European national and regional legislation (i.e. Germany, France and the EU) on Due Diligence in Human Rights have become increasingly important and generated obligations for companies and their managers; both for its headquarters, and its subsidiaries and value chain.
Thus, the innovative international standard on human rights established by the Guiding Principles imposes on companies the responsibility of preventing, mitigating and, in certain cases, relieving the negative impact caused by their activities on Human Rights.
Practices
Human rights due diligence
We design processes considering the type of industry and organization-specific characteristics.
The human rights program provides companies with accurate, real evidence of management considering the highest standards of responsible corporate conduct under international developments in the matter.
It also allows to:
-
Diagnose, prevent, mitigate and relieve negative impact on human rights
-
Respond to partners’ requirements and their headquarters
-
Be prepared to respond to requirements from multilateral financial entities (IFC, World Bank) and commercial corporate banks
-
Anticipate and reduce reputational and operational risks associated with socio-environmental conflicts
-
Monitor and review regularly
-
Publish reports
Communication and prior consultation
We specialize in designing communication and prior consultation strategies focused on human rights. We work closely with local communities likely to be impacted.
In addition, we establish relationships with national and international human rights entities.
International litigation and legal advice
We represent the company’s interests in the event of reports in the United Nations Working Group on Business and Human Rights and the national contact points of the OECD.
We have broad experience working with international human rights protection systems, both from government positions, the civil society and private consultancy. We also have experience in Corporate Law, which provides us with a comprehensive view of the issues.
Education
We provide human rights training for all levels of the organization.
Our approach involves incorporating concepts and generating tools necessary to carry out your work as part of a comprehensive human rights plan.
